These Terms of Service (“Terms”) govern your access to and use of the Lessonwise AI website and any related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

Definitions “Service” means the Lessonwise AI website and any related services. “User” means any person who accesses or uses the Service. “Content” means any text, graphics, images, music, software, audio, video, information, or other materials. “Lessonwise AI,” “we,” “us,” or “our” means Lessonwise AI, Inc.

To impersonate or attempt to impersonate Lessonwise AI, a Lessonwise AI employee, another user, or any other person or entity.
To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

Intellectual Property Rights The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Lessonwise AI, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Disclaimer of Warranties Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis. Lessonwise AI makes no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. Lessonwise AI makes no warranty that the results that may be obtained from the use of the Service will be accurate or reliable. You acknowledge that the Service may be subject to temporary disruptions, outages, or errors.
Limitation of Liability In no event will Lessonwise AI, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind arising out of or in connection with your use of, or inability to use, the Service, including any direct, indirect, special, incidental, or consequential damages, including but not limited to loss of revenue, lost profits, loss of data, or damages resulting from lost goodwill, interruption of business, or computer failure or malfunction, even if foreseeable or even if Lessonwise AI has been advised of the possibility of such damages.
Indemnification You agree to defend, indemnify, and hold harmless Lessonwise AI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Service or your use of the Services, including, but not limited to, your User Contributions, any use of the Services’ content, services, and products other than as expressly authorized in these Terms of Service, or your use of any information obtained from the Services. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
Termination LessonwiseAI reserves the right, in its sole discretion, to terminate or suspend access to all or part of the Service, with or without notice, for any reason, including breach of these Terms of Service. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your access to this Service, and may be referred to appropriate law enforcement authorities.
Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without giving effect to its conflicts of law provisions.
Indemnification You agree to indemnify and hold LessonwiseAI, its affiliates, officers, agents, employees, and partners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms of Service, or your violation of any rights of another.
Limitation of Liability In no event shall LessonwiseAI, its officers, directors, employees, partners, or affiliates be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, whether based on contract, tort, negligence, strict liability, or otherwise, resulting from: (a) the use or the inability to use the Service; (b) unauthorized access to or alteration of your transmissions or data; (c) statements or conduct of any third-party on the Service; or (d) any other matter relating to the Service.
No Waiver of Rights The failure of LessonwiseAI to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms of Service remain in full force and effect.
Entire Agreement These Terms of Service constitute the entire agreement between you and LessonwiseAI and govern your use of the Service, superseding any prior agreements between you and LessonwiseAI. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software.
